Consent to processing materials for AI generation

1. Recipient and purpose of consent

I voluntarily permit the controller Зубович Евгений Михайлович, email e.zubovich@yandex.ru, to process my submitted materials to create three garden design variants based on my request, prepare selected additional materials, provide and store results in my account for repeat access and handle my enquiries concerning this request. The controller and recipients are described in the privacy policy.

Materials include the garden image, plan and dimensions, wishes, style, region and optional budget parameters. If these contain my personal data, consent covers processing for the stated purpose. I do not submit documents, biometric identification data, special-category data or third-party personal data without a legal basis.

2. Processing and transfer

Permitted actions are collection, recording, organisation, storage, retrieval, use, disclosure to the specified AI provider to fulfil the request, blocking, deletion and destruction. Processing is automated, with support staff involvement where an enquiry is made.

AI provider: AITunnel (aitunnel.ru). Consent does not permit publication of my materials, advertising mail or use of my photo in advertising. Overseas transfer requires the controller to meet applicable legal requirements, not merely this checkbox.

3. Duration and withdrawal

I consent through a separate action: checking an initially unchecked box before submitting the request. It is not part of offer or analytics consent. Consent covers the launched request and storing its results in the ordered history until the purposes are achieved, the account is deleted or consent withdrawn, whichever comes first. To withdraw, contact the controller under “Provider”, stating the login and materials. Consent-based processing stops and data are destroyed within article 21 deadlines of No. 152-FZ, generally within 30 days absent another legal basis. Only processing with an independent legal basis may continue.

The local planner can be used without consent. External AI generation of these materials will not start. Withdrawal does not end processing on an independent legal basis, including mandatory payment records.

Confirmation records the user ID, consent version, date and request ID. The box starts unchecked; consent for this launch does not pre-authorise other purposes.

Uploaded photo checks

When enabled, uploaded photos are automatically checked for signs of personal data before being sent to the external AI provider. The check runs locally on the 3D Dacha server without sending the photo to external checking services. It aims to detect faces, vehicle plates and clearly recognisable contact details (emails and phone numbers). It does not identify individuals; recognised contact strings and plate numbers are not separately stored or written to checking logs.

On confirmed detection, the photo is rejected and not sent to AI. Generation is not delivered for that material; another garden photo without these elements is required. The rejected photo is removed from the task and its draft. No final credit deduction occurs and any reservation is returned. Rejection is not service delivery and does not remove rights to recover unused prepayment under the offer and law.

Automatic checks have limitations and cannot guarantee detection of all personal data. Ordinary text and watermarks alone are not grounds for refusal. For uncertain results, errors or timeouts, users see “The photo must not contain personal information (faces or personal details)” and may continue generation. If an administrator disables checks, photos go to the external AI provider without personal-data checks. Users must inspect materials before upload and exclude personal data; the operator’s duties to protect any personal data actually received remain.

For interiors, materials include the room photo, room type, style, change level, wishes and items to keep. They are processed to create and store the room design with the same AI provider and the access, photo-checking, retention and deletion rules described here.
